If you are considering your options and want to understand what divorce would mean for you practically and financially, we are here to help.
No-fault divorce was introduced in England and Wales in April 2022. It means that neither party needs to blame the other or prove that the marriage has broken down due to specific conduct. You simply need to confirm that the marriage has irretrievably broken down. This has made the process significantly less adversarial and means you can proceed even if your spouse does not agree. You must have been married for at least one year before you can apply.
No. Since the introduction of no-fault divorce in April 2022, one person can apply for divorce without the other's agreement. Your spouse will be notified of the application and given the opportunity to respond, but they cannot prevent the divorce from proceeding simply by refusing to engage. The court will grant the divorce unless there is a very specific legal reason not to, which is extremely rare.
The minimum timeframe under the current process is around six months from the date the application is submitted. In practice, most straightforward cases are concluded within six to twelve months. Cases involving contested financial arrangements or complex assets can take longer. We will give you a realistic timescale based on your specific circumstances at your first consultation.
In the majority of cases, no. The divorce application itself is an administrative process and does not require a court hearing. Financial settlements and arrangements for children can also be resolved without attending court in most cases, provided both parties are willing to negotiate. We always aim to resolve matters by agreement where possible, as it is less stressful, faster and generally less expensive. We will only recommend court proceedings where there is a genuine need to do so.
Financial arrangements, including the family home, savings, pensions, investments and other assets, are dealt with separately from the divorce itself. Reaching a financial settlement is one of the most important aspects of the process. Arrangements can be agreed between you and your spouse and made legally binding through a consent order, or determined by the court if agreement cannot be reached. We strongly recommend putting a formal financial settlement in place before your divorce is finalised, as failing to do so can leave you financially exposed in the future.
Arrangements for children, including where they live and how much time they spend with each parent, are dealt with separately from the divorce. In most cases, parents are able to agree arrangements between themselves, sometimes with the help of solicitors or a mediator. Where agreement cannot be reached, the court can make a Child Arrangements Order. Throughout any proceedings, the welfare of the child is the court's paramount consideration. We can advise you on all aspects of arrangements for children and help you reach an outcome that works for your family.
